- General Provisions.
1.1. These terms and conditions of purchase and sale (hereinafter – the Terms) are a legally binding document for the Parties, setting out the rights, obligations, and liability of the Buyer and the Seller when the Buyer purchases goods in the online store.
1.2. The Seller reserves the right to amend, correct, or supplement the Terms at any time, in line with the requirements of applicable law. The Buyer is informed via the online store's website. The Terms in force at the time of placing an order apply to the Buyer's purchase.
1.3. The following persons have the right to purchase in the online store:
1.3.1. legally capable natural persons, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;
1.3.2. legal persons;
1.3.3. authorized representatives of all the persons listed above.
1.4. By accepting the Terms, the Seller also guarantees that, based on point 1.3 of the Terms, the Buyer has the right to purchase goods in the online store.
1.5. The contract between the Buyer and the Seller is deemed concluded from the moment the Buyer, having created a shopping cart in the online store, indicated the delivery address, chosen a payment method, and reviewed the Seller's Terms, clicks the "Confirm Order" button (see point 5 "Ordering goods, prices, payment procedure, deadlines").
1.6. Every contract concluded between the Buyer and the Seller is stored in the online store.
2. Protection of Personal Data.
2.1. The Buyer may order goods in the online store:
2.1.1. by registering in this online store – entering the data requested during registration;
2.1.2. without registering in this online store.
2.2. When ordering goods by the methods set out in point 2.1 of the Terms, the Buyer must provide, in the relevant fields provided by the Seller, the personal data necessary for the proper fulfillment of the order: first and last name, delivery address, phone number, and email address.
2.3. By accepting these Terms, the Buyer agrees that the personal data provided under point 2.2 may be processed for the purposes of selling goods and services in the online store, analyzing the Seller's activities, and direct marketing.
2.4. By agreeing that the Buyer's personal data may be processed for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees that informational messages necessary for fulfilling the order may be sent to the email address and phone number provided by the Buyer.
2.5. When registering in the online store and ordering goods, the Buyer undertakes to keep their login details secure and not disclose them to anyone.
3. Rights and Obligations of the Buyer.
3.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms and other information sections of this online store.
3.2. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
3.3. If the data provided in the Buyer's registration form changes, the Buyer must update it without delay.
3.4. The Buyer undertakes not to disclose their login details to third parties. If the Buyer loses their login details, they must immediately inform the Seller using the contact details specified in the "Contact" section.
3.5. By using the online store, the Buyer agrees to these purchase and sale Terms and undertakes to comply with them and not violate the laws of the Republic of Lithuania.
4. Rights and Obligations of the Seller.
4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the online store.
4.2. If the Buyer attempts to compromise the stability and security of the Seller's online store, or violates their obligations, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer's ability to use the online store, or, in exceptional cases, to cancel the Buyer's registration.
4.3. The Seller undertakes to respect the Buyer's right to privacy regarding the Buyer's personal information provided in the online store's registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. Ordering Goods, Prices, Payment Procedure, Deadlines.
5.1. The Buyer may purchase in the online store 24 hours a day, 7 days a week.
5.2. The contract takes effect from the moment the Buyer clicks the "Confirm Order" button, and once the order is received, the Seller confirms it – sends a confirmation email to the address provided by the Buyer.
5.3. The prices of goods in the online store and in the order placed are indicated in euros, including VAT.
5.4. The Buyer pays for the goods using one of the following methods:
5.4.1. payment via online banking – this is an advance payment made using the Buyer's online banking system. To use this payment method, the Buyer must have an online banking agreement with one of the following banks: SEB bankas; AB "Swedbank"; "DNB Nord" bank; "Citadele" bank; "Ukio bankas"; "Danske" bank; "Nordea" bank. The Buyer transfers the funds to the online store's bank account. In this case, responsibility for data security lies with the respective bank, since all monetary transactions take place within the bank's online banking system.
5.4.2. Payment by bank transfer – this is an advance payment where the Buyer, having printed out the order and gone to the nearest bank branch, transfers the funds to the online store's bank account.
5.5. The Buyer undertakes to pay for the goods without delay. The shipment of goods only begins to be prepared, and the delivery deadline only begins to run, once payment for the goods has been received.
6. Delivery of Goods.
6.1. Goods are delivered to the Buyer within the territory of the European Union countries within 2–5 business days, and to countries outside Europe within 3–7 business days from the receipt of payment for the goods.
6.2. The Buyer, having chosen a delivery service when ordering, undertakes to specify the exact delivery location for the goods.
6.3. The Buyer undertakes to accept the goods in person. If the Buyer is unable to accept the goods in person, and the goods are delivered to the specified address, the Buyer has no right to make claims against the Seller regarding delivery of the goods to the wrong person.
6.4. The goods are delivered by an authorized representative of the Seller (a courier).
6.5. The Seller's authorized courier delivers the goods to the Buyer in accordance with the deadlines specified in the product descriptions. These deadlines are preliminary and do not apply in cases where the required goods are not available in the Seller's warehouse, in which case the Buyer is informed of the shortage of the ordered goods. The Buyer also agrees that, in exceptional cases, delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to contact the Buyer without delay and agree on the terms of delivery.
6.6. In all cases, the Seller is released from liability for breach of delivery deadlines if the goods are not delivered to the Buyer, or are delivered late, due to the Buyer's fault or due to circumstances beyond the Seller's control.
6.7. The Buyer must, in all cases, immediately inform the Seller if the shipment is delivered in a crushed or otherwise damaged package, if the shipment contains goods that were not ordered, an incorrect quantity of goods, or an incomplete set of goods.
6.8. In all cases, if the Buyer notices damage to the packaging upon delivery, they must note this in the delivery document provided by the courier, or draw up a separate report on the damage. The Buyer must do this in the presence of the courier. If this is not done, the Seller is released from liability to the Buyer for damage to the goods related to packaging damage that the Buyer did not note in the courier's delivery document.
7. Quality and Warranty of Goods.
7.1. The general characteristics of each product sold in the online store are indicated in the product description accompanying that product.
7.2. The Seller is not responsible for the fact that the color, shape, or other parameters of the goods shown in the online store may not correspond to the actual size, shape, and color of the goods due to the characteristics of the monitor used by the Buyer.
7.3. Where the Seller has not provided a quality warranty for certain types of goods, the warranty provided for by the relevant legal acts applies.
8. Return and Exchange of Goods.
8.1. When returning goods, the Buyer must comply with the following conditions:
8.1.1. it is preferable, but not mandatory, that the returned item be in its original, undamaged packaging;
8.1.2. the returned item must be in the same set/configuration as received by the Buyer;
8.1.3. the returned item must be clean;
8.1.4. the shelf life of the returned item must not have expired;
8.1.5. a written request must be submitted indicating the wish to have the amount paid by the Buyer refunded or to exchange the item for a quality item;
8.1.6. a document confirming the purchase of the item must be provided (a receipt, an invoice, or a document confirming acceptance of the item).
8.2. The Seller has the right not to accept goods returned by the Buyer if the Buyer does not comply with the return procedure set out in Article 8.1.
8.5. If the wrong item and/or a defective item was received, the Seller undertakes to collect such items and replace them with equivalent, suitable items.
8.6. If the Seller does not have suitable items available for exchange, the amount paid by the Buyer is refunded, excluding the delivery fee.
9. Liability of the Buyer and the Seller.
9.1. The Buyer is fully responsible for the accuracy of the personal data they provide. If the Buyer provides inaccurate personal data in the registration form, the Seller is not liable for any consequences arising from this and acquires the right to claim compensation from the Buyer for any direct losses incurred.
9.2. The Buyer is responsible for actions taken while using this online store.
9.3. A registered Buyer is responsible for disclosing their login details to third parties. If the services of the online store are used by a third party who has logged in using the Buyer's login details, the Seller considers this person to be the Buyer.
9.4. The Seller is released from any liability in cases where losses arise because the Buyer, disregarding the Seller's recommendations and the Buyer's obligations, did not read these Terms, even though they were given the opportunity to do so.
9.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations, or persons, the Seller is not responsible for any information or activities found there, does not manage or control those websites, and does not represent those companies or persons.
9.6. In the event of damage, the party at fault shall compensate the other party for direct losses.
10. Marketing and Information.
10.1. The Seller may, at its own discretion, initiate various promotions in the online store.
10.2. The Seller has the right to unilaterally, without separate notice, change the terms of promotions, as well as to cancel them. Any change or cancellation of the terms and procedure of promotions applies only going forward, i.e. from the moment such changes are made.
10.3. The Seller sends all notices using the contact details specified in the Buyer's registration form.
10.4. The Buyer sends all notices and questions to the phone numbers and email addresses specified in the "Contact" section of the Seller's online store.
10.5. The Seller is not liable if the Buyer does not receive informational or confirmation messages sent due to disruptions in internet connection or email service providers' networks.
11. Final Provisions.
11.1. These terms and conditions of purchase and sale have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
11.2. All disagreements arising from the performance of these Terms shall be resolved through negotiation. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
